THE SHORT VERSION
8 STATES SUE OPENAI OVER KIDS' SAFETY — AG: ‘THE CONSEQUENCES OF THAT ASSURANCE ARE LIVES LOST AND PEOPLE HARMED’
Arkansas Attorney General Tim Griffin filed suit against OpenAI, alleging the company represented ChatGPT as safe while knowing it had significant risks and limitations and hiding that knowledge from consumers. Griffin said the complaint outlines violations of Arkansas law that boil down to misleading assurances, adding that the consequences of that assurance are lives lost and people harmed.
The Arkansas filing cites three sets of claims: violations of the Arkansas Deceptive Trade Practices Act, violations of the Children's and Teens' Online Privacy Protection Act over collecting and retaining minors' personal information, and common-law claims including negligence, design defect, failure to warn, unjust enrichment and public nuisance. Similar lawsuits were filed the same day by the attorneys general of Iowa, Kansas, Nebraska, West Virginia, Arizona, Idaho, Montana and Utah, making eight coordinated state actions in total in the Reuters count, with Arkansas listed among them in its own release.
