THE SHORT VERSION

THE STATES WANT OPENAI TO DISGORGE EVERY DOLLAR IT MADE OFF YOUNG USERS

A bipartisan group of eight states sued OpenAI in state courts on October 14, alleging ChatGPT is designed to be agreeable and engaging to earn users' trust while reinforcing delusions, encouraging dangerous behaviour and assisting with planning violence. The suits accuse OpenAI of violating state consumer protection laws by misleading users about safety and of creating a public nuisance.

The states seek civil penalties, damages and orders forcing changes to how ChatGPT works, including barring development of self-improving models unless they can be ensured to align with human values. Arkansas's parallel filing also pleads unjust enrichment and seeks restitution to affected consumers, the mechanism by which the states aim to claw back money earned from users they say were misled about the product's safety, particularly young users.
