THE SHORT VERSION
ANTHROPIC ASKS THE FULL D.C. CIRCUIT TO KILL THE PENTAGON'S CLAUDE BLACKLIST
Anthropic filed a petition on October 13 asking the full U.S. Court of Appeals for the D.C. Circuit to rehear its challenge to the Pentagon's designation of the company as a national security supply-chain risk. The designation, made under the Federal Acquisition Supply Chain Security Act, bars the Pentagon and its contractors from using Claude in work for the department.
The petition follows a September 25 ruling in which a three-judge panel voted 2-1 to uphold the designation. Rehearing en banc is rarely granted and requires a majority of active judges. The court has held its September ruling from becoming final while it considers the request, and if rehearing is denied Anthropic could seek Supreme Court review.
